You will need a “Commissioner of Oaths” to sign an affidavit, which is a document in which you declare and affirm that a set of statements is true. At LawStop, all of our lawyers are authorized commissioners of oaths by the Province of Ontario. We are available to witness all kinds of affidavits, sworn declarations, and oaths for our clients. You could be asked to affirm a declaration when you make an application to the government, by a company when they require critical information, or by the court if you are a witness or party in a court case. In some cases, these forms are given to you, however sometimes you may be required to write them yourself.
A "Notary Public" is a person authorized by the Province of Ontario to witness declarations and certify true copies of documents and signatures. All lawyers at LawStop are Notaries Public. Usually, declarations which are to be sent outside of Ontario need to be “notarized” in addition to being commissioned. You may also need the services of a notary public if you require certified true copies of documents. This process involves making photocopies of the original document and then “certifying” them as true copies of the original, whereby a notary public signs and seals the copies and makes the legally binding statement that the copy is certified.
Most of the time we can commission and notarize your documents on a walk-in basis. We are also here to assist you in writing your affidavit or declaration; once you provide the pertinent information, one of our lawyers will draft the declaration, you will sign the declaration in front of the lawyer, and finally, the lawyer will commission or notarize the document with their signature and stamp or seal.
